These terms and conditions apply to the services available from the domain and sub-domains of www.BidWinInvest.com. FEFY ECOMMERCE PRIVATE LIMITED is a Firm incorporated under Indian Firm act in which and its Internet platform is www.BidWinInvest.com and our users in the version applicable on the date of use. Your participation in bidding offered by the website BidWinInvest.com (hereinafter referred to as the “Website”) is subject to only open to Indian Citizens residing in India and are of age 18 years and over.

 

BUYING OF POINTS
1. Each user needs to buy some points in order to place bids. This credit amount given at BidWinInvest website cannot be transferred, willed, donated, en-cashed, or refund. The credit Amount will have validity as per decided by the company and will be informed and remove at its sole decision of the company.

2. User must provide the valid account details information at the time of purchase of bids in the payment gateway.

3. User must be the owner of the bank account through which medium done the payment.

4. KYC Verification may be done of Users who will pay more than Rs.10,000/-. So User can’t Deny for KYC Verification.

5. BidWinInvest does not save any bank information provided by you it only required by the payment gateway in order to verify your account for the misuse of the same which is encrypted itself.

6. We use one or more well-established and reputable third party payment service providers for the acceptance of online payments to purchase the points. Therefore, we will not be liable for any compromise, misuse of this information or breach of security by these third party payment service providers.

7. We reserve the right at its sole discretion to cancel/bar any winner from claiming the product without any kind of refund if in case winner is not able to pay the invoice amount or submit the required documents and payment within 3 days from the day/date of intimation to process/fulfil the same.
**Note- Whether Invoice applicable or not it must be specified on that particular Auction/Product page.

9. Bidding fees varies by auction and ranges anywhere between Rs. 3 per bid to Rs. 50 per bid and will be stated in each auction promotion. Bidding fee is at the discretion of BidWinInvest.

 

BIDDING
1. A bidder can place a bid in between 0.1 to a maximum bid amount mentioned at each product. Always remember that bid must be exactly to ONE decimal place other than this pattern will consider as an invalid bid. Winner will be the lowest unique bidder who will be lowest and unique till the auction closed.

The entire auction winner declared as soon as the auction closed sometimes there may be a period of up to 72 working hours from when an Auction closes until the auction results are announced. This period is to allow for the reconciliation of Bids and the auditing of results for genuine winner if server detects any fraud if fund auction will be cancelled & the corresponding user will be blocked from our platform temporarily. Note: do not place any bids before 60secs of closing of an auction because it is the reconciliation periods for bid status to declare the instant winner, If you placed any bids in this time periods then some bids may placed & some are not, So it will be at your own risk..

2. As a Winning buyer you must contact BidWinInvest within seventy-two (72) hours of auction closing successfully at our contact us page and complete all the formalities else your claim may be denied. This is mandatory and no exception will be made whatsoever.

3. Bids cannot be cancelled. By bidding for an item you agree to be bound by the conditions of bid included in the item`s description (go to the description) so long as those conditions are not in violation of the Terms and Conditions or unlawful. In case of consumer goods, sellers on the Service may or may not specify the retail prices of the items being sold. You are advised to independently verify the retail prices of such items if you so desire.

4. We wish to inform you that there might be times when due to failure in the network or firewall issues, you might not receive update mails from BidWinInvest. Therefore, you are requested to kindly log on to www.BidWinInvest.com & check your bid status from time to time.

5. We wish to inform you that do not place any bids at last 60 secs as it required by the server to reconcile of bids & declare the genuine winners. If you placed any bids then it will be placed by your own risk because, there may be some bids placed & some are not, it completely depends upon the server due to the heavy traffic.

6. For every bid that you place, a portion of amount goes into an investment part in your user profile. You can claim the object in which your points were invested once the claim button is available on website in the investment page. Amount of investment on bids will solely be decided by BidWinInvest. Customers will not be entertained to invest on the object directly or ask any queries on the same.

 

HOLIDAY VOUCHER / TOUR PACKAGES
BidWinInvest shall not be responsible to provide any travel documents such as Passport, Visa, Travel Permit, travel insurance etc. BidWinInvest’s liability is restricted to purchase of the tour package at the winning rate from the tour operator, for the benefit/use of the winning participant. BidWinInvest would not be responsible for any future act of the winning participant, which may result into either cancellation or non-performance of agreement on the part of the tour operator.

BidWinInvest shall not be responsible or liable in case the tour package on offer cannot be made available on the ground that the country, or any one of the countries, which is promised in such tour, have either become inaccessible due to any extreme weather condition, any natural disaster or calamity or if there is an advisory from Ministry of External Affairs, Government of India, to the effect that travelling to such a country is to be avoided on grounds of safety due to rioting, agitations or any other adverse geopolitical situation which may have ensued in the said country or region.

The winning participant would have to provide to the tour operator, personal information of the travelers for the purposes of booking and reservations. In case the winning participant fails to provide such information or document, as may be necessary, in the time stipulated by such tour operator, or provides incorrect and false information, to the tour operator, BidWinInvest shall not be responsible for cancellation of the tour due to the above referred acts or omissions on the part of the winning participant.

BidWinInvest shall not make, or is liable to make any change, modification, alteration or adhere to any special request, with respect to the Holiday Voucher / Tour Package. However, such changes, modifications, alterations or special request, if any, could be requested to the tour operator directly by the winning participant.

Any claim arising out of deficiency of service with respect to the Holiday Voucher / Tour Package would lie against the tour operator. Under no circumstances would BidWinInvest be responsible or liable to make good the losses suffered on the above mentioned ground.

 

CARS & BIKES
Vehicle images and descriptions posted on our website pages are for demonstrative purposes only. Please note that actual vehicle may differ slightly from specifications and/or the pictures.

BidWinInvest shall not provide or be liable to provide any mandatory document required for registration of the product. BidWinInvest shall not be responsible for arranging for winning participant’s proof of identity or a driving license issued by the competent authority.

BidWinInvest shall be liable to only pay for the ex-showroom price of the car/bike. All costs towards registration, insurance, accessories etc. shall be borne by the winning participant himself unless otherwise specified.

Any loss of property or life by usage of the car/bike offered to the winning participant shall not be the responsibility of BidWinInvest. BidWinInvest shall not indemnify any winning participant against any third-party claim arising out of the users of the car/bike.

Any claim arising out of deficiency of service or manufacturing defect with respect to the car/bike would lie against the dealer or the manufacturer. Under no circumstances would BidWinInvest be responsible or liable to make good the losses suffered on the above mentioned grounds.

All terms and conditions set-out or laid down by the agent, dealer or manufacturer, as the case may be, shall bind the winning participant, as if they were set out in a bipartite agreement between agent, dealer or manufacturer as one party and the winning participant as the other party.

Any claim or application for redemption of warranty, with respect to the car/bike shall be made directly before the agent, dealer or manufacturer, as the case may be.

BidWinInvest reserves the right to choose the colour of the vehicle while procuring the same for the winning participant. However, BidWinInvest may accede to a colour of the winning participant’s choice if the winning participant is willing to make up for any difference in the cost on account of choice of colour.

 

BIDWININVEST DOES NOT REPLACE THE DEALER, MANUFACTURER, TOUR OPERATOR OR SUPPLIER
BidWinInvest only provides opportunity to its customer to win/buy the products or services on offer at a winning rate. All other incidents attached to the ownership of the product or to being the recipient of the services offered e.g. warranty, guaranty, service, maintenance etc., if any, shall be governed by the Terms & Conditions set out or laid down by the supplier, agent, dealer, manufacturer, tour operator or service provider, as the case may be, and the same shall have to be pursued by the winning participant himself.

 

SERVICES OR PRODUCTS ARE NOT TRANSFERABLE
The products or services offered by BidWinInvest are meant only for the winning participant and under no circumstances will they be transferable to another party. However, in case of a car/bike, the winning participant may, after he has become the lawful owner of the same, transfer the same to any party in accordance with law.

 

BIDWININVEST MAY ALTER, CHANGE OR MODIFY THE OFFER
BidWinInvest reserves the right to change, alter or modify the products or service on offer at any time without prior notice to the participants.

BidWinInvest reserves the right to extend the auction closing date without and prior notice to its participants.

 

JURISDICTION
Jurisdiction with respect to any litigation or legal claim arising out of any dispute between the participant and BidWinInvest shall be with the Courts at Bengaluru.

 

ELIGIBILITY TO USE
Before bidding you are requested to please read thorough all the terms and conditions, privacy policy, and other policy/offer documents.

1. He / She is aged 18 or over, or as legally required in the country of residence must be in India.

2. Each user only opens a single BidWinInvest account.

3. Provides a valid E-mail id.

4. Provide a valid mobile number.

5. Provides Use names and/or addresses and/or personal data.

6. Winner must have to provide the Id proof & address proof for delivery of the product.

DELIVERY POLICY
Pictures of the displayed produce on website are not the exact picture of the location or the product itself. They are modified suitably for the purpose of advertisement.

Accessories reflected in the picture do not form the part of the offered product and can be procured on payment from dealers.

Unless otherwise stated, items are sold with no warranty or guarantee.

Delivery of the product will be obtained by the winner from the nearest dealer or address communicated by BidWinInvest.

Winner will take the delivery of the product or avail the services after being satisfied about all the aspects about the product/services including the qualitative aspects. BidWinInvest claims no responsibility for that.

Holiday Vouchers will be sent on the registered email of the Winner.

Bidding price includes cost of the product/service only, all other cost including but not limited to Insurance, freight, carriage , accessories, taxes, registrations, licenses, permits and approvals etc will be sole responsibility of Winner.

No product or service shall be exchanged for cash or any other mode of payment by BidWinInvest , however the customer may be free to enter a deed or agreement with any third party for sale of his product or service beyond and after the completion of the sale agreement with BidWinInvest and fulfillment of the entered binding contract.

 

RETURN POLICY
Return Policy of any good and services same as that offered by the Seller, if any. BidWinInvest does-not have any return policy of its own.

BidWinInvest shall entertain complaints from customers to evaluate and record quality of the product and service provided by the seller.

BidWinInvest reserves the right to participate in providing support to its customer in resolving any issues/dispute that may arise with the seller.

In any circumstances, there would be no refund policy from BidWinInvest.

 

GENERAL TERMS AND CONDITIONS
BidWinInvest is not a game of chance the price quoted tests the skills of the people to come out with unique number propositions and so is not game of chances.

This is a product enabling our customers to use their skill set to quote for various products or services listed on the Portal.

Lowest and unique quote will be declared winner on the end of a game.

Upon quoting, it is agreed upon that you have read, understood and agreed to all terms and polices of this portal.

If you quote and your quote is selected as unique and lowest then you are legally bound to follow through with sale of item.

It is agreed upon that at the time of quoting you have resolved and exhausted all and any questions concerning the item(s) of which you quote for. High quoters found asking questions after the close of the game will be denied sale of item and item shall be relisted.

We rely on updates from other users at time of auction and post updated info promptly and do-not take responsibility or claim geniuses of any Quote.

It is understood that all sales are final and all items sold as is, with some exceptions of course. Please refer to our Return Policy above for details.

None of our games/auctions are open to international bidders.

Prize won is nontransferable.

Prize won will not be exchanged with any other product/Service.

All Quotes will be subject to Tax Laws of India.

Winner will be responsible to obtain all necessary approvals, licenses, permits, insurance, Visa, Passport etc. to legally use the product or services as per the Laws of Land.

All the payments will be made through normal banking channels only, as per various means available on the Portal.

BidWinInvest reserves the right to prohibit an individual to Bid without providing any reasons or explanation.

BidWinInvest reserves the right to modify its policies, terms and conditions from time to time without any prior intimation.

 

CONTRACTUAL OBLIGATIONS
A contract is the obligation between BidWinInvest and users. A valid contract allows users to involve in the auction process. By submitting your Quotes, you make a legal offer to buy the product. Once accepted by BidWinInvest, a contract is initiated between the buyer and the site for the sale and purchase with the terms validated by the company from time to time.

 

DISCLAIMER
BidWinInvest or its partners, licensors or associates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use BidWinInvest, including their legal representatives, directors, agents, controlled companies and employees shall not be liable for incorrect or incomplete contents published on the site or concerning the Service whether these are generated by users, Members or any other instrument or program associated to the Service or used by the Service.

BidWinInvest shall not be liable for any technical malfunction or problem of any network or telephone line, online computer system, server or provider, computer equipment, software, lack of e-mail or traffic congestion of the Internet or any site or combination of these, including tort or damage to user or Member computers and computer of any person, that may arise from taking part or downloading material related to the BidWinInvest Web Site or its Services.

If you are dissatisfied with the Website, then you have to stop to using its Services. Any material downloaded or otherwise obtained through the use of the Website is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from such download.

You agree to indemnify, defend and hold BidWinInvest, harmless from all claims, damages and expenses made by any third party arising out of your content, your use of the website, your connection to BidWinInvest, or your violation of these Terms or Privacy Policy.

 

PASSWORD / SAFETY
Your login ID and password is your sole property that you use to access our services. Once assigned to you, you are the person responsible for its safety and unauthorized use. If your password is compromised or otherwise disclosed, change it immediately to prevent any risk of loss. You are solely responsible for maintaining the security of your personal information.

 

FRAUDULENT BEHAVIOUR
At BidWinInvest we strictly prohibit users to Quote under a false name or with invalid credit card details. Such attempts are deemed as straight violation of laws. A bidder found guilty of fraudulent bidding, will be reported to relevant state and law enforcement agencies for further course of action.

A winner may not resell a product obtained through the site unless a written permission/NOC is obtained from BidWinInvest. If he is found guilty of doing so, the company reserves the right to suspend the account without further notice.

Following are the activities that strongly prohibited on BidWinInvest and may invite stringent legal action.
1. Accessing, modifying or destroying any information of another BidWinInvest user by any fraudulent means.

2. Any attempt to infringe the BidWinInvest property

3. Manipulation the Quoting process by placing fictitious Quotes.

4. Fail to pay for the items purchased.

5. Post content that is false, inaccurate, misleading and defamatory.

6. Attempt to collect personal data of the users on the website.

 

TERMINATION OF THE CONTRACT
BidWinInvest reserves the right to terminate these terms or suspend access to the site any time, without prior intimation. Termination may take place if your use of the Service violates these terms or potentially illegal to BidWinInvest.

 

COMPLIANCE WITH THE LAWS
Once registered with BidWinInvest, you shall at all time comply with various rules regulations put in place to watch the use of the services including Quoting and purchase on the site. We shall perform no obligations set forth in this agreement if any of your acts would violate any present or future law, regulation or policy set by the authorities.

 

UNEXPECTED SPECIAL CONDITION
1. If any such case no one gets the lowest unique bid status by closed of the auction then the auction again live for bidding to find the Lowest Unique Bidder for winner.

Example:

If bidder A placed 0.1

bidder A placed 0.2

bidder B placed 0.1

bidder B placed 0.2

bidder B placed 0.3 and

the last bidder C placed 0.3 (here no results are unique)

As all the bids are not unique hence there is no Lowest Unique Bidder for that so our server unable to declare the winner for the same. In such cases, Winner is announced as the one who has placed the lowest bid and also placed maximum number of biddings in that product.

In case we are not able to find any winner from the above calculations, we again place the same auction for bidding as all the bids placed by the users are not unique, so we will try to search for next lowest bidder by making the auction live again for next one hour.

2. If 60% bids are not placed for every Auctions then the same auction may cancelled or the bid date may be extended & refund will be given to all participated users if cancelled.

3. If any users won a certain item and do not complete the formalities within an week from date of inform, he/she will needs to deposit a minimum of Rs 2000 in order to proceed further.

4. If any fraud found on any particular auctions then the winner’s bids will be cancelled & declared the new genuine winner who is the previous Lowest Unique Bidder, If previous not found from the winning bid then goes for next Lowest Unique Bidder after the fake winners bids.
